What Is Your State Doing?


Session Dates: March 3 – May 1; The Legislature meets in regular session on the first Tuesday after the first Monday in March of each year. A regular session may last 60 consecutive calendar days, including Saturdays and Sundays, and may be extended by a three-fifths vote of the Members in each legislative house.

S70      GENERAL BILL by Aronberg  (Identical H 0721)
School Nurses/Epinephrine Auto-injectors [SPSC]; Provides that a district school board may authorize a school nurse to maintain supplies of prefilled epinephrine auto-injectors at schools in the school district. Provides requirements for prescriptions. Authorizes use for emergency treatment, etc.  EFFECTIVE DATE: 07/01/2009.

S78      GENERAL BILL by Wilson  (Compare H 1203, S 2476)
School Grading System [SPSC]; Removes letter grades from the performance grade categories by which schools must be identified in the Commissioner of Education's annual report of the results of the statewide assessment program. Conforms provisions to changes made by the act.  EFFECTIVE DATE: 07/01/2009.

School Progression & Retention/Reading Proficiency [SPSC]; Revises the components of school district student progression programs. Eliminates guidelines for allocating resources for school district remedial and supplemental instruction. Eliminates mandatory retention requirements for certain students in grade three. Eliminates midyear promotion. Eliminates standards for exemption from mandatory retention. Revises guidelines for remedial reading instruction and intervention strategies, etc.  EFFECTIVE DATE: Upon becoming law.

Compulsory School Attendance/Age Requirement [SPSC]; Changes the ending age for mandatory school attendance from 16 to 18 years of age.  EFFECTIVE DATE: 07/01/2009.

Statewide Educational Assessment Program [SPSC]; Requires that the Commissioner of Education receive input as to the statewide educational assessment program from a minimum of two persons recommended by the Florida School for the Deaf and the Blind and from a minimum of two persons recommended by the Americans with Disabilities Working Group.
EFFECTIVE DATE: 07/01/2009.

STOP Day/Stopping Violence in Schools; Recognizes April 17, 2009, as "STOP Day" in the State of Florida.

School Attendance/Withdrawing from School [SPSC]; Requires that a student who is withdrawing from school be assigned a counselor or other school personnel to provide educational information until the student is 18 years old. Requires 9th graders and students who are withdrawing from school to receive instruction about the effects of withdrawing from high school and certain available options.  EFFECTIVE DATE: Upon becoming law.

S94      GENERAL BILL by Wilson
Teachers/Public School/Cost-of-living Increase [SPSC]; Requires the Legislature to fund a cost-of-living increase in the General Appropriations Act for teachers who teach prekindergarten through grade 12 in the public school system.  EFFECTIVE DATE: 07/01/2009.

Public Schools/Reading Lab for Grades 1-3 [SPSC]; Requires that certain students who are enrolled in a public elementary school and reading below grade level be placed into an intensive reading lab. Specifies criteria for such a reading lab. Provides for oversight of the progress of students assigned to a lab. Requires the principal of a public school where students in grades 1 through 3 are enrolled to create, by hiring or training, a team of teachers having expertise in specified areas, etc.  EFFECTIVE DATE: 07/01/2009.

S100     GENERAL BILL by Wilson
Voluntary Prekindergarten Education Program [SPSC]; Revises the number of instructional hours that are required for a school-year prekindergarten program delivered by a private kindergarten provider and by a public school. Revises the number of instructional hours that are required in order for a student in a school-year prekindergarten program delivered by a public school or a private prekindergarten provider to be considered a full-time equivalent student in the Voluntary Pre-K Education Program.  EFFECTIVE DATE: 07/01/2009.

S112     GENERAL BILL by Bullard  (Identical H 0677)
Cell Phone Use/Operating Vehicles in School Zones [CPSC]; Prohibits the use of a cellular telephone while operating a motor vehicle in a school zone. Provides an enhanced penalty.  EFFECTIVE DATE: 07/01/2009.

S122     GENERAL BILL by Constantine  (Compare CS/CS/CS/S 1128)
Exceptional Students with a Disability [SPSC]; Requires the Department of Children and Family Services, the Agency for Health Care Administration, and residential facilities licensed by the Agency for Persons with Disabilities to notify certain school districts following the placement of an exceptional student in a private residential care facility. Requires review of the student's individual educational plan. Provides for determining responsibility for educational instruction, etc.  EFFECTIVE DATE: 07/01/2009.

S146     GENERAL BILL by Bullard
School Entry Requirements/Swimming Life Skills [SPSC]; Requires children who enter public or private schools in the state to present evidence of  having completed a class in swimming life skills conducted by a certified instructor. Provides for certain exemptions from the requirement, etc.  EFFECTIVE DATE: 07/01/2009.

S194     GENERAL BILL by Wilson
School-entry Requirements/Vision Examinations [SPSC]; Requires children who enter public or private schools in the state to present evidence of having received a comprehensive vision examination. Requires the imposition of a fee on the retail sale of nonprescription eyeglasses.
Provides for the fee to be used by the DOH to assist parents in paying for school-entry comprehensive vision examinations. Requires rules for eligibility for and the distribution of funds, etc.  EFFECTIVE DATE: 07/01/2009 except as otherwise provided.

S196     GENERAL BILL by Wilson
School Wellness and Physical Education Policies [SPSC]; Revises each school district's requirement for reviewing its wellness and physical education policies. Provides specific guidelines for a school district's wellness and physical education policies with regard to nutrition education, physical activity, school-based activities, and nutritional guidelines for food and beverages sold or served on campus, etc. EFFECTIVE DATE: 07/01/2009.

S220     GENERAL BILL by Deutch; (CO-INTRODUCERS) Rich; Bennett; Sobel; Joyner;
Wilson  (Identical H 0265)
Public Schools/Human Sexuality Education [SPSC]; Creates the "Florida  Healthy Teens Act." Requires public schools that provide certain information or programs to students concerning human sexuality to provide information that meets specified criteria. Provides a process to
review compliance with such requirement. Authorizes parents and guardians to seek review of a school's compliance, etc.  EFFECTIVE DATE:   07/01/2009.

S232     JOINT RESOLUTION by Wilson  (Similar H 0617)
Full-time Public School Teachers/Minimum Salaries [SPSC]; Proposes an amendment to the State Constitution to set minimum salaries for new and experienced full-time public school teachers, commencing in 2012. The minimum salary for a new school teacher must be the national average salary for new school teachers. The average salary for experienced
teachers must be no less than the national average salary for public school teachers, etc.

S290     GB  Florida Comprehensive Assessment Test (FCAT) [SPSC]

Florida Comprehensive Assessment Test (FCAT) [SPSC]; Removes the requirement that a district school board adopt policies for meeting class size maximums which allow a student to graduate from high school if the student passes the grade 10 FCAT. Removes the requirement that a student earn a passing score on the FCAT or alternative assessment to graduate from high school. Removes the requirement that a student pursuing an accelerated 3-year high school graduation earn a passing score, etc.  EFFECTIVE DATE: 07/01/2009.

Public Libraries/Internet Safety Education Program [GPSC]; Encourages all public libraries to implement an Internet safety education program for children and adults. Provides minimum requirements for the program. Requires libraries to annually report to the Division of Library and
Information Services of the Department of State the number of participants who complete the program. Requires that the division adopt rules to award additional points to grant applicants implementing such a program.  EFFECTIVE DATE: 07/01/2009.

S346     GENERAL BILL by Justice; (CO-INTRODUCERS) Sobel  (Identical H 1503)
High School Graduation Requirements/Health Educ. [SPSC]; Provides for a mandatory one-half credit in health education, independent of physical education credit requirements, for high school students who enter their first year of high school in 2008-2009. Provides a waiver for students who request to take and successfully complete a health education assessment developed by the Department of Education. Reduces the number of credits in elective courses.  EFFECTIVE DATE: 07/01/2009.

Public School Dress Requirements [SPSC]; Prohibits a student from exposing below-waist underwear in a specified manner while on the grounds of a public school.  EFFECTIVE DATE: 07/01/2009.

Increases the credit hour requirements for a student to remain eligible for a scholarship. Permits a one-time restoration of scholarship eligibility.  EFFECTIVE DATE: 07/01/2009.

Zero-tolerance Policies/Schools [SPSC]; Requires that a district school board having a policy authorizing corporal punishment as a form of discipline review its policy on said punishment at specified intervals. Provides that zero-tolerance policies do not require the reporting of
  petty acts of misconduct and misdemeanors to a law enforcement agency. Encourages school districts to use alternatives to expulsion or referral to law enforcement agencies, etc.   EFFECTIVE DATE: 07/01/2009.

Speed Zones/K-12 Schools [CPSC]; Requires the installation of traffic and pedestrian control devices at certain K-12 schools unless a traffic engineering analysis determines that the devices are not necessary. EFFECTIVE DATE: 07/01/2009.

  (Identical H 7089)
Exceptional Students [SPSC]; Revises provisions relating to due process hearings for exceptional students. Provides that any party to a hearing related to gifted students may request that the findings or decision be reviewed by the district court of appeal. Authorizes a district school
board to consider a change in placement for a student who has a disability if the student engages in behavior that violates the district school board's code of student conduct, etc.  EFFECTIVE DATE:  07/01/2009.

Educator Certification [SPSC]; Revises provisions relating to reports and records in cases of child abuse or neglect. Requires that employees or agents of the Department of Education who are responsible for the investigation or prosecution of misconduct by certified educators be
granted access to such records. Requires that the State Board of Education adopt rules incorporating the Florida Educator Accomplished Practices, etc.  EFFECTIVE DATE: 07/01/2009.

Public School Athletic Coaches/Certification [SPSC]; Provides that completion of a sports safety course shall meet certain certification requirements. Requires the sports safety course to be approved by the Florida High School Athletic Association Board of Directors and to meet
specified requirements.  EFFECTIVE DATE: 07/01/2009.

Notification of School Personnel/Child Felony [SPSC]; Requires that specified school personnel be notified when a child of any age is formally charged by a state attorney with a felony or a delinquent act that would be a felony if committed by an adult.  EFFECTIVE DATE: 07/01/2009.

S2124    GENERAL BILL by Wise  (Identical H 0999)
Educational Choice/Class Size Grant Program [WPSC]; Establishes the Class Size Grant Program to provide the option to attend a public school other than the one to which a student is assigned, or to provide a class size grant to a private school of choice, for students assigned to
classrooms that exceed constitutional class size limits. Provides school district, DOE, and Commissioner of Education obligations and authority, etc.  EFFECTIVE DATE: 07/01/2009.

S2174    GENERAL BILL by Wise
Public K-12 Education/Social Studies Standards [SPSC]; Provides requirements for social studies standards relating to civics education. Requires that social studies standards be included in assessments. Requires that the Florida Comprehensive Assessment Test measure student
content knowledge and skills in social studies. Requires that the Commissioner of Education undertake the development of comprehensive assessments of social studies beginning with the 2011-2012 school year, etc.  EFFECTIVE DATE: Upon becoming law.

S2232    GENERAL BILL by Siplin  (Similar H 1527)
High School Graduation [SPSC]; Establishes the General Education Development Exit Option Program. Provides eligibility criteria for students to enroll in the program. Provides an exemption for students enrolled in the program from the minimum graduation requirements for a
standard high school diploma. Requires that a student who is enrolled in the program be promoted to grade 10 or the grade level of his or her cohort group upon enrollment in the program, etc.  EFFECTIVE DATE: Upon becoming law.

S2386    GENERAL BILL by Dean  (Compare CS/H 0543, 2ND ENG/H 7087)
Educational Assessment [SPSC]; Provides for discontinuation at the end of the 2008-2009 school year of the Florida Comprehensive Assessment Test in science administered to students in grade 11. Requires the science assessment administered at the high school level to be one or more end-of-course examinations. Specifies requirements for an end-of-course examination.  EFFECTIVE DATE: Upon becoming law.

S2394    JOINT RESOLUTION by Gaetz  (Compare CS/CS/1ST ENG/H 0919, S 1828)
  School Average Class Size [WPSC]; Proposes an amendment to the State   Constitution to increase the number of students who may be assigned to a public school teacher. However, the average number of students per teacher may not exceed the current class size limits. For
  prekindergarten through grade 3, a teacher may not have more than 23students. However, the average number of students per teacher for this grade grouping at a school may not exceed 18 students, etc.

Educational Instruction [SPSC]; Requires that the instructional staff of a public school teach a thorough presentation and critical analysis of the scientific theory of evolution and certain governmental, legal, and civic-related principles.  EFFECTIVE DATE: 07/01/2009.

Public School Education [SPSC]; Requires reimbursement to school districts for reasonable costs for student transportation to certain schools and choice programs. Deletes the requirement that a student earn a passing score on the Florida Comprehensive Assessment Test (FCAT) for
purposes of high school graduation. Deletes mandatory retention for certain grade 3 students. Changes the school grading system to a school performance system, etc.  EFFECTIVE DATE: 07/01/2009.

Schools/Students with Disabilities/Restraint [SPSC]; Prohibits school personnel from manually physically restraining a student with disabilities. Provides an exception in emergency cases when there is a imminent and significant threat to the physical safety of the student or others. Prohibits mechanical restraint, prone restraint, and other specified methods of restraint. Requires the school to medically evaluate a student as soon as possible after the student is manually
physically restrained, etc.  EFFECTIVE DATE: 07/01/2009.

School Improvement and Accountability [SPSC]; Redefines the term "secondary school" to no longer include an elementary school serving students through grade 6 only. Revises provisions relating to accelerated high school graduation. Revises the credits for certain courses required under the 3-year standard college preparatory program beginning with students who enter grade 9 in the 2009-2010 school year, etc.  EFFECTIVE DATE: 07/01/2009.

Public K-12 Educational Funding [SPSC]; Prohibits the use of school district funds for the funding of or contracting with community-based organizations to provide noninstructional programs or services that are not required by law.  EFFECTIVE DATE: 07/01/2009.

Physical Education [SPSC]; Clarifies provisions requiring that a school district notify a student's parent regarding certain options available to the student as an alternative to participation in physical education. EFFECTIVE DATE: 07/01/2009.

S2608    GENERAL BILL by Justice  (Similar H 1231)
Public School Student Progression [SPSC]; Requires student proficiency in additional subjects. Provides a process by which the retention of a student for a reading deficiency may be appealed. Provides for exemption from mandatory retention through successful appeal. Specifies circumstances recognized as justification for granting an appeal. Provides for reporting.  EFFECTIVE DATE: 07/01/2009.

students be advised of the availability of certain courses for purposes of an accelerated high school graduation option, etc.  EFFECTIVE DATE:  07/01/2009.

HB 13 Middle School Civics Education Assessment: Provides requirements for civics education course that student must successfully complete for middle grades promotion beginning with students entering grade 6 in 2011-2012 school; requires administration of end-of-course assessment in civics education as field test at middle school level during 2011-2012 school year; provides requirements for course grade & course credit for subsequent school years; requires inclusion of civics education end-of-course assessment data in determining school grades beginning with 2012-2013 school year. Effective Date: July 1, 2

HB 355 - Teacher Retention GENERAL BILL   by Kiar (CO-SPONSORS) Bullard
Teacher Retention: Requires school report card delivered to parents in school district to include district's teacher turnover rate; creates Florida Teacher Induction Initiative to provide support to new teachers; requires district to develop & implement initiative; requires district to submit plan to address its new teacher attrition rate under certain circumstances; requires DOE to establish data collection & reporting system to determine annual district cost of replacing teachers; requires DOE to conduct study to determine relationship of teacher retention & attrition to student academic achievement. Effective Date: July 1, 2009

HB 457 - Public School Funding GENERAL BILL   by Taylor, D. (CO-SPONSORS) Bullard; Pafford; Rogers; Soto. Public School Funding: Provides for school district flexibility in 2009-2010 fiscal year to expend specified funds for operating expenses; requires district school board adoption of resolution & approval of amendment to school district's operating budget; deletes restriction on expenditure of capital outlay millage for educational facilities & sites under lease-purchase agreement; deletes restriction on expenditure of operating revenues made available through payment of property & casualty insurance premiums. Effective Date: July 1, 2009

HB 813 - Instructional Materials for K-12 Public Education GENERAL BILL   by Hays (CO-SPONSORS) Legg Instructional Materials for K-12 Public Education: Deletes provision that restricts cost to students for replacement of certain instructional materials that are lost, destroyed, or damaged. Effective Date: July 1, 2009

HB 1203 - Public School Education GENERAL BILL   by Kiar (CO-SPONSORS) Jenne
Public School Education: Requires reimbursement to school districts for certain transportation costs; deletes grade 10 FCAT as requirement for high school graduation; revises FCAT components & use of concordant scores for FCAT scores; deletes mandatory retention for certain grade 3 students; changes school grading system to school performance system; changes Florida School Recognition Program to Every Child Matters Program & revises use of program funds.
Effective Date: July 1, 2009

HB 1527 - High School Graduation GENERAL BILL   by Randolph High School Graduation: Creates general educational development (GED) exit option as alternative route to receipt of standard high school diploma; specifies eligibility requirements for student participation; authorizes participation in extracurricular activities; provides certain exemptions & requirements for successful completion of GED exit option. Effective Date: July 1, 2009
